以下是2010年我写的一篇警示文章,今天看到JIANG BO被捕的的新闻,觉得有必要重贴一次,希望更多人看到。下面的案子中的两名华人算是幸运的。其他很多人就没有这么轻松了,不少被关入了联邦监狱。 教训:任何时候都不要拿公司的资料、源代码等回家。 2010-06-13 15:08:59 我的知识产权官司的陪审团审判是5月14日结束的,结果是陪审团判被告公司侵权全部成立。其间我注意到主审法官的日程表上有几起刑事案,USA对某某某中国人。该法官去年底曾经判处一名中国来的工程师入狱,现在联邦监狱服刑。罪名是商业间谍之类。美国的历届政府一直是对所谓中国人窃取技术实施严打。 今天一个偶然的机会,我看到了一个报导,说该法官推翻了美国政府对两名华裔工程师栗澜与葛跃飞的部分指控。这两个名字正是我在法庭看到榜上有名的。于是找到了法官的命令书,了解情况。 原来,栗澜与葛跃飞都是硅谷一家叫NETLOGIC的公司的前雇员。根据FBI搜查的结果,在此二人的计算机上都发现了NETLOGIC的一些技术资料,而且发现此二人成立了自己的公司,准备在中国开发竞争性产品,并且在中国申请风险投资。被告则辩称,这些文件都是老掉牙了,相关信息部分已经在网上公开,不属于商业机密。美国联邦政府根据这些证据起诉栗澜与葛跃飞5项罪名,并于2006年将其逮捕。陪审团审判在2009年进行。 陪审团挑选过程中,美国政府曾经试图去掉一名叫QIN YUQIANG的华人,但被告律师指责这是种族歧视。审判结果,陪审团就针对TSMC的两项经济罪行指控宣判无罪。QIN YUQIANG在判决后接受记者采访时认为,美国政府没能提供足够证据证明被告获取的信息属于商业机密。他认为,政府至少应该找一个中立的证人,而不是完全依赖NETLOGIC的证词,因为NETLOGIC对案件的结果有明显的经济利益。 但剩下的三款,陪审团未能达成一致。包括阴谋进行经济间谍活动罪(第一款),经济间谍罪(第二款),窃取商业机密罪(第四款)等。 法官2010年5月21日的命令把第一款和第二款给废掉了。理由是,要证明间谍罪,美国政府并需证明被告意图向中国政府提供相关商业机密;在该案中,奥巴马政府并没有提供任何被告想给中国任何好处的证据,政府提供的唯一证据是被告想从中国得到好处。 就窃取商业机密一款指控,双方存在争议,法官认为从对美国政府最有利的方向看,被告的行为可能构成了窃取商业机密,因此这一款控罪需要重审。即使如此,对美国政府来说,其关键的四项矛头实际是针对中国的指控被TRASH(该词引自英文报道),而只剩下纯属两个老百姓个人行为的商业机密案,这不是一件很愉快的事。 葛跃飞的律师说,在葛的计算机上发现了NETLOGIC的文件,对很多被告来说,那就是定罪的铁证了( "For a lot of people that was the beginning and the end of it" )。
刚看了CCTV关于飞虎队的节目,其所请军事专家陈洪犯了几个历史错误,而且是很显然的错误。下面我根据记忆,略述其一二。 该专家最大的概念错误就是以为飞虎队是美国民间组织的一支志愿军。这位专家甚至称这些美国飞行员以前是飞运输机的,跑到中国飞战斗机,打得日本人落花流水。其实,稍微想一下就知道,这几乎是不可能的事情。 实际上,飞虎队是在美国总统罗斯福亲自过问下成立的。其飞行员是从美军现役人员中招募,飞行员中60人来自美国海军与海军陆战队,40人来自美军陆军航空兵。买飞机的钱也是美国政府提供的。当然,这在当时属于秘密行动,表面上是民间组织。 CCTV嘉宾说飞虎队的飞机是在租借法案(Lend-Lease)下获得的,这也是个基本历史错误。租借法案是1941年通过的,这个法案意味着美国结束中立状态。飞虎队筹备时美国奉行中立主义,国会通过一系列法案不准向交战国出售武器。但1939年的中立法加了一项,允许英国与中国等现买自运军火(Cash and carry)。飞虎队的装备是在这个”现买自运”名目下购买的。如果是通过租借法案,就不需要付钱。 xi
